MIKE SMITH'S SERVICE GUARANTEE

If I or my assistant fail to contact you weekly with an update or a progress report, at close of escrow we will deduct $50.00 from our commission for every week missed.

If after 14 days after your property is listed, I fail to advertise your property on a daily basis in either the Register-Guard, Home Seekers, Harmon Homes, television, radio or Internet for the term of your listing or until you sign an acceptable Earnest Money Agreement, at close of escrow we will deduct $20.00 from our commission for every day that an advertisement did not run.

If we fail to close escrow by the predetermined date set in the Earnest Money Agreement, at close of escrow we will deduct $25.00 per day for every day after the closing date (excluding sale-fall through's and buyer withdraws).

If I fail to install a lock box or "For Sale" sign (if applicable) within 24 hours after I receive the listing agreement, at close of escrow we will deduct $25.00 from our commission for every day that a lock box or "For Sale" sign was not installed.

If I fail to enter the listing of your home into the Multiple Listing Service (if applicable) within 48 hours (excluding weekends) after I receive it, at close of escrow we will deduct $25.00 for every day that your home was not listed with the Multiple Listing Service.

MIKE SMITH'S SALE GUARANTEE

We will sell your home within 90 days (when listed at current market valuation). If I haven't brought you a fair offer* by day 91, I will deduct $1,000.00 off my commission at closing. Then, I will reduce my commission by another $20.00 every day until only $20.00 remains for me at closing. THERE ARE THREE RULES, AND THEY ARE ALL REASONABLE AND SIMPLE:

First, this Guarantee applies to houses, townhouses, manufactured homes with their own land, and condominiums, not to vacant land.

Second, I can only guarantee to sell a property if I know there is a market for it at or near the price which it is offered, so rule number two is that at least 3 properties comparable to yours must have sold in your area within the past three months. You must price your property at what we both agree is fair market value now. The price at which these properties sold will determine our fair market value (with any adjustments, if necessary to best match your home).

The third rule is that you must do your part by making all necessary repairs prior to the starting date of this Sale Guarantee. The property must be neat, clean and available for showing during reasonable hours whenever a prospective buyer wants to see it. If the property has had good exposure, and we have not received any offers within the first 45 days, we will reduce our price by 5%.

THE BENEFITS TO YOU: You will get a faster sale with fewer inconveniences when your home is priced properly. You will see an increase in sales person response, as well as better response to advertising and sign calls. All of this provides you with maximum exposure to prospects. Homes priced in this manner will actually net the seller more money at the time of closing.

By agreeing to this Sales Guarantee, all parties agree to abide by the terms and conditions as set forth in said Guarantee. If the Seller fails to fulfill any term or condition set forth in said Guarantee, this shall automatically terminate this Guarantee.

Closing or Settlement >Walk Through Woes

Buyers can be a little cranky on closing day if things go wrong during the walk-through inspection. For example, the sellers' dependable old dishwasher might stop midway through its cycle and the bathroom sink might clog unexpectedly. These situations can create anxiety for the buyers and sellers, but such problems are quite common and usually simple to resolve.

Most purchase agreements require that the major mechanical systems and the appliances being conveyed are in working order at the time of the closing. Defects are often discovered during the structural inspection, allowing the sellers plenty of time to have the repairs made. Occasionally there are last-minute breakdowns or defects that are not spotted until the walk-through inspection. In that case, an agreement can be made with the sellers at the closing to escrow funds for the repair or replacement of the items in question.
